TABANAN, DEWATA.NEWS – Members of the Tabanan Regional House of Representatives (DPRD) have identified alleged violations of river setback regulations at a villa construction project in Kerambitan District, raising concerns over spatial planning compliance and incomplete permits.

The inspection was carried out by Commission I of the Tabanan DPRD at a villa development site in Banjar Dinas Pasut, Tibubiyu Village. Lawmakers found that the building stands extremely close to the Yeh Ho River and is suspected of breaching mandatory river buffer zone regulations.

Commission I chair I Gusti Nyoman Omardani said the structure is located only around 130 centimeters from the riverbank, far below the minimum distance required under national regulations.

“Under existing rules, river areas outside urban zones with embankments must have a minimum setback of five meters from the outer edge of the embankment. What we found on site clearly does not meet that requirement,” Omardani said on Friday (30 January).

In addition to the alleged spatial planning violation, the project was found to lack complete construction permits. According to information obtained during the inspection, the developer has not yet secured a Building Approval (PBG) and is still in the process of applying for Spatial Planning Approval (ITR).

The project also does not yet have a Certificate of Proper Function (SLF), which is required once construction is completed. Omardani added that inspectors also found an unlicensed drilled well within the project area.

“Not only that, we also discovered the construction of a bore well that does not have the required permit,” he said.

Following the findings, Commission I formally requested that all construction activities be temporarily halted. Workers were instructed to leave the site, and the project owner was asked to coordinate with relevant authorities, particularly the Public Order Agency (Satpol PP), by presenting all land ownership and permit documents.

“Our recommendation is clear: construction activities should be stopped before any sealing measures are taken. The owner must meet with the relevant agencies to synchronize the data. Only then can further recommendations be determined,” Omardani said.

He emphasized that the core issue lies in the violation of river setback regulations. While the local legislature supports investment, Omardani stressed that all development must comply with applicable laws.

“We are not against investment. However, this building clearly violates river setback rules. Construction must stop for now. If all requirements are later fulfilled in accordance with regulations, the project may proceed,” he concluded.
